1. About These Terms
These Terms and Conditions ("Terms") govern your use of the Irlen North Charitable Trust website (the "Site") and your relationship with Irlen North Charitable Trust ("the Trust", "we", "us", "our"). By accessing or using the Site, making a donation, or otherwise engaging with our services, you agree to be bound by these Terms.
The Trust is a registered charitable trust operating in New Zealand [CC64442]. If you do not agree with these Terms, please do not use the Site.
2. Our Purpose
Irlen North Charitable Trust exists to raise awareness of Irlen Syndrome and to support people in Northland and wider New Zealand to identify treatment options, including referring them to independent screeners, diagnosticians, and treatment providers. We do not diagnose or treat Irlen Syndrome ourselves.
3. Information on This Site
The information provided on the Site — including articles, self-assessment tools, guides, and referral information — is general in nature and is provided for educational and awareness purposes only.
It is not medical, clinical, optometric, or professional advice, and should not be relied on as a substitute for a proper assessment by a qualified practitioner.
Any self-assessment quiz or screening tool on the Site is intended as a general indicator only and does not constitute a diagnosis.
We make reasonable efforts to keep information accurate and current but do not warrant that all content is complete, up to date, or error-free.
If you have concerns about your own or someone else's vision, learning, or wellbeing, please seek advice from an appropriately qualified professional.
4. Referrals to Treatment Providers
The Trust may provide names, contact details, or links to independent screeners, optometrists, or Irlen-certified diagnosticians and treatment providers ("Providers").
Providers are independent of the Trust. We do not employ, supervise, or control Providers, and a referral or listing is not an endorsement or guarantee of any Provider's qualifications, services, pricing, or outcomes.
Any agreement you enter into with a Provider is strictly between you and that Provider. The Trust is not a party to, and accepts no responsibility or liability for, that arrangement or any advice, treatment, or service you receive.
We encourage you to carry out your own checks on any Provider before proceeding.
5. Donations
We are grateful for donations from members of the public, funders, and grant-making organisations.
All donations are made voluntarily and, once processed, are non-refundable, except where required by law or at our discretion in cases of genuine error (e.g. duplicate or incorrect payment).
Donations are used to further the charitable purposes of the Trust, including awareness, education, and support activities, in accordance with our Trust Deed and any specific conditions attached by a funder.
Where a donation is made for a specific purpose or appeal, we will use reasonable endeavours to apply it accordingly. If circumstances make this impossible, we may apply the donation to a similar purpose consistent with our charitable objects.
Online donations are processed through a third-party payment provider. We do not store your full payment card details. Please refer to our Privacy Policy for how we handle your personal information.
If the Trust holds current donee organisation status with Inland Revenue, donations may qualify for a tax credit or deduction. We recommend you keep your donation receipt and confirm your own eligibility with Inland Revenue or your tax advisor, as this is not something the Trust can advise on.
6. Acceptable Use
When using the Site, you agree not to:
use it for any unlawful purpose or in a way that breaches any New Zealand law or regulation;
attempt to gain unauthorised access to any part of the Site or its systems;
upload or transmit anything harmful, defamatory, offensive, or that infringes another person's rights;
misrepresent your identity or affiliation with the Trust.
We may suspend or restrict access to the Site for anyone who breaches these Terms.
7. Intellectual Property
All content on the Site — including text, logos, graphics, quizzes, and other materials — is owned by or licensed to the Trust and is protected by copyright and other intellectual property laws, unless otherwise stated. You may view and share content for personal, non-commercial purposes, but may not reproduce, modify, or distribute it for commercial purposes without our prior written consent.

The Site may contain links to third-party websites, including Providers, funders, and other organisations. These links are provided for convenience only. We do not control and are not responsible for the content, accuracy, or privacy practices of any external site.

To the maximum extent permitted by law:
the Trust makes no warranties or representations, express or implied, about the accuracy, completeness, or reliability of the Site or its content;
the Trust will not be liable for any loss or damage (direct, indirect, or consequential) arising from your use of the Site, reliance on its content, or your dealings with any Provider or third party referred to on the Site;
nothing in these Terms excludes any right or remedy you may have under the Consumer Guarantees Act 1993 or the Fair Trading Act 1986 that cannot lawfully be excluded.
11. Indemnity
You agree to indemnify and hold the Trust, its trustees, staff, and volunteers harmless from any claim, loss, or damage arising from your misuse of the Site or breach of these Terms.
